That is legal argument.  It is not evidence.  Witness statements should deal with the facts of the case.

@activist Hopefully the Judge will pick up the points that convoy is making.....

He can make the points in the hearing. He can make what are called "submissions" as to what the facts of the case are, based on the evidence presented by the parties, and how the law applies to those facts.

I submitted my docs as ordered on the day to both court and claimant.

But up to today I've not received the claimants papers, I've checked with the court and she had submitted to the court on the correct day as i, so ive had it noted.

Cant understand as she was ,I believe being assisted by CAB and would always send 2 copies recorded etc etc

@convoy2 Given what you say, I wouldn't worry too much. She has filed with the court so there is no chance of her modifying her witness statement ( as in my case) to counter any arguments that you have made. Give it til Monday close of play. If you have not received her statement/s inform the court in writing. Any longer than that and I would suggest asking the court for a) an order compelling her to deliver and then b) a postponement so that you have adequate time to review her information. It may also be possible to request the court to photocopy her documents for you to collect or get them posted to you. I've no idea how that will go down as I've no legal experience. I wrote quite a few 'complaint' letters to the court and they didn't seem to get frowned upon. As far as I can work out and have seen, LIPs get far more help than a solicitor would. Chin up!

I am not concerned as there is little she can add I feel, I have WS from everyone concerned. Just scratching my head as why she has not served me.

Also LIP or not , J wont be impressed.

So still no docs.

Ive spoken to the court twice and emailed, the first time they said the believe that the court have sent them last Friday and the reason the claimant gave is that, I told her that I did not want her coming to my house, which is rubbish because 1. I never and 2. she always sends them recorded delivery.

I rang back when the docs didn't arrive today in post and now they think the claimant may have said she sent them Friday but then the Clerk couldn't understand why the court would have sent also, they also say that the written docs have been sent and photos but only b a W photocopy and no video evidence which was supplied. I asked could i come over and collect a copy , but was told no.

What a shambles. Piss up in brewery/left hand doesn't know what right hand is doing... The only way the court would send you her docs if she lodged them there, requesting they post them to you. Can't see them doing that... Stay calm... any longer and you should request a new date... maybe.. ? Did you keep my phone number ???

Have you written to the Claimant to request these things?
